YOU ARE HEREBY NOTIFIED that on the 14th day of October, 2008, at 8:30 A.M., in Courtroom 1F at the Gwinnett Justice and Administration Center, 75 Langley Drive, Lawrenceville, Gwinnett County, Georgia, the presiding Judge of the Superior Court of Gwinnett County will hear the case of the State of Georgia, Plaintiff v. Joint Development Authority of DeKalb County, Newton County and Gwinnett County and GGCF I, LLC, Defendants, Civil Action File No. 08-A-08659-7, in the Superior Court of Gwinnett County, the same being a proceeding to confirm and validate an issue of Joint Development Authority of DeKalb County, Newton County and Gwinnett County Revenue Bonds (GGCF I, LLC Project), Series 2008 (the Series 2008 Bonds), in an aggregate principal amount not in excess of $112,000,000. The Series 2008 Bonds are to be issued by the Joint Development Authority of DeKalb County, Newton County and Gwinnett County (the Issuer) and the proceeds are to be applied to finance, in whole or in part, the acquisition, construction and installation of a certain Project in Gwinnett County, Georgia, in order to develop and promote the public good and general welfare of the County of Gwinnett and its inhabitants and to promote the general welfare of the State of Georgia. Said Project will be financed by the Issuer for the benefit of GGCF I, LLC, a Georgia limited liability company, pursuant to a Loan Agreement, to be dated as of October 1, 2008 or as of the first day of the month in which the Series 2008 Bonds are issued. In said proceeding the Court will also pass upon the validity of said Loan Agreement, a Note, a Security Deed and a Trust Indenture in connection therewith. The Issuer will not conduct any performance audit or performance review with respect to the Series 2008 Bonds as such terms are described in Section 36-82-100, Official Code of Georgia Annotated.
Any citizen of the State of Georgia residing in Gwinnett County, Georgia, or any other person wherever residing who has a right to object, may intervene and become a party to this proceeding.

TO THE QUALIFIED VOTERS OF GWINNETT COUNTY
NOTICE is hereby given that on the 4th day of November, 2008, an election will be held in all the election districts of Gwinnett County, at which time there will be submitted to the qualified voters of said County for their determination the question whether or not there shall be imposed within the Special District of Gwinnett County a special 1% sales and use tax for a maximum period of five (5) years commencing on April 1, 2009, which revenues from said tax shall be used and applied for the purposes of roads, streets, and bridges, public safety facilities and equipment, recreational facilities, libraries, County court facilities, City water and sewer capital improvements, City administrative facilities and City parking facilities, and to pay all expenses necessary to accomplish the foregoing projects, and any excess proceeds shall be used and applied as provided in the Special Tax Act.
Voters desiring to vote for the imposition of said special 1% sales and use tax for the aforesaid purposes shall do so by voting "YES" and voters desiring to vote against the imposition of said special 1% sales and use tax for the aforesaid purposes shall do so by voting "NO" as to the question propounded, to-wit:

The proposed project would extend Sugarloaf Parkway as a limited access four-lane arterial roadway with a depressed 44-foot wide median from New Hope Road to State Route 316 (University Boulevard), covering a distance a approximately 3.66 miles. The proposed section would consist primarily of two 12-foot travel lanes in each direction, a 44-foot depressed grassed median, and 6-foot wide shoulders along the inside and 16-foot wide shoulders along the outside edges of pavement, all within a 200-foot right-of-way. The proposed project would create a diamond interchange at Martins Chapel Road, and realign approximately 0.68 miles of Martins Chapel Road. New traffic signals would be installed at the Martins Chapel Road interchange ramp termini. The interchange at Campbell Road would be an overpass bridge with ramp intersections to the west and a loop access to the side road on the east side of the parkway at a location approximately 0.05 miles south of the existing Campbell Road/Alcovy Road intersection. Existing Campbell Road would be realigned and improved from the new interchange to new intersection that is approximately 0.47 miles in length, with Alcovy Road opposite Alcovy Springs Drive. At the end of the project, a partial cloverleaf interchange with approximately 2 miles of entrance and exit ramps on both the eastbound and westbound sides of SR 316 are planned connect Sugarloaf Parkway to SR 316 (University Parkway) providing adequate traffic flow management at this major arterial state route.
Sugarloaf Parkway would cross over Alcovy Road and would pass under Hiram Davis Road. The construction of the Hiram Davis Road overpass and the Alcovy Road underpass would require the reconstruction of 0.23 and 0.30 miles of the respective roads. Due to grade difficulties and to minimize adverse impacts, Bramlett Shoals Road would be closed on both sides of the Sugarloaf Parkway Extension. To maintain traffic flow, a two-lane connector road approximately 0.42 miles in length would be constructed from Martins Chapel Road to Bramlett Shoals Road, beginning and ending approximately 0.10 miles north of the proposed bridge crossing at Bramlett Shoals Road. This new connector road would be approximately 0.50 miles long, inside a 100-foot right-of-way. The total length of the proposed project is approximately 3.66 miles.
Stream S3, a perennial tributary of Shoal Creek, originating near Hiram Davis Road and Saddleback Way respectively, will be impacted by the extension of the proposed Sugarloaf Parkway. The project will relocate 1,150 feet of stream S3. Stream S3 will be relocated outside of the proposed construction on the south side of Sugarloaf Parkway and it will be relocated north of the new road in a new channel, and approximately 200' will cross under Sugarloaf Parkway through a new channel reinforced concrete box culvert. A permanent water quality pond, designed in accordance with the Gwinnett County Stormwater Management Manual and the Georgia Stormwater Management Manual will be installed on the north side of Sugarloaf Parkway. The pond will collect the storm water runoff and treat it for the removal of 80% of the Total Suspended Solids from the first 1.2" of rainfall for the impacted area. A stream buffer variance would be required for the impacts to this stream.
Impacts to the project would be significant if the buffer variance were not allowed. The proposed project is designed to alleviate congestion. Because of rapid growth in and around the proposed project area, it is necessary to establish better and safer traffic conditions as described above. If no stream buffer variance were allowed, travel and traffic conditions in the area would deteriorate. Consequently, there has been a significant investment in time and money for planning and research, right-of-way acquisition, and roadway design. The ramifications of an underdeveloped transportation system in this area include, but are not limited to, reduced economic productivity and stunted growth. The cumulative effect of an underserved transportation corridor can result in quality of life concerns for the traveling public that use this facility at times of peak demand.
The public is invited to comment during the 30-day period on the proposed activity. Since the Environmental Protection Division has no authority to zone property or determine land use, only those comments addressing environmental issues related to air, water, and land protection will be considered in the application review process.
